Laws relating to health and safety are another area which the employer should be aware of. Under Section 2 of the Health and Safety at Work Act, employers have a duty to provide adequate information, instruction and training to their workforce. This is also part of their common law duty of care. Under these laws employers may well have a duty to provide information about HIV and its modes of transmission.
