As in any area of the law, it is essential to base legal responses (if they are to be effective) upon a good empirical understanding of the target to which it is hoped the law will attach.... AIDS laws must not be based upon ignorance, fear, political expediency and pandering to the demand of the citizenry for ‘tough’ measures.... Good laws, like good ethics, will be founded in good data.

This chapter has provided an introduction to the fundamental issues affecting policy and legal responses to HIV, highlighting the tensions between public health and human rights.

The following chapters will examine the specific ethical, legal, scientific and social concerns in greater detail. The penultimate chapter will explore what impact the application of the criminal law to potential or actual HIV exposure or transmission has had – or may have – on public health and human rights.
